$190,000.00 Settlement at Trial in Automobile Accident Case
On June 16, 1997, two cars going through an intersection in Brooklyn were involved in a collision. One of the drivers involved originally went to another attorney, who suggested using a law firm that concentrates in personal injury law and recommended Besen and Trop. This Manhattan attorney, like many others in the area, refers all of his personal injury business to our firm.
Besen and Trop were retained to handle the case. The first issue was a question of liability. Stuart Besen was able to show that the defendant had a stop sign at this intersection and that our client did not. This fact and the point of contact between the two vehicles convinced the defendant's insurance carrier to quickly throw in the towel and concede liability.
The other issue was obtaining proper compensation for our client's neck injuries, which required a C5-6 Diskectomy six months after the accident. The defendant's attorney claimed the operation was not related to the accident but to a previous accident and to a bullet lodged in our client's neck. Besen rejected settlement offers of $125,000.00 and 150,000.00 and prepared the case for trial. On the eve of the trial, the defendant's attorneys and insurance company backed down and met Besen's demand of $190,000.00.
