The following is a case summary as reported in The New York Jury Verdict Reporter, the leading reporter of verdicts and settlements of cases in New York State.
$159,925.00 Pedestrian Accident Case
A 16 year old girl crossing a street near her home was struck and injured by a car. She suffered injuries including a fractured wrist and severe damage to her right knee requiring surgery and extensive physical therapy. Unfortunately, the owner and operator of the car carried only the minimum New York State insurance of $25,000.00, which obviously would not be enough to compensate the girl for her injuries. Stuart Besen, representing the young girl, reviewed the family's insurance policy, and found the mother of the injured girl had additional SUM (Supplementary Uninsured Motorist) coverage under her own policy. Stuart Besen made a claim on behalf of the girt, collecting the full amount of the additional insurance thus increasing the amount received to $100,000.00. Mr. Besen then set up a structured annuity further increasing the client's settlement package to $159,925.00.
