The following is a case summary as reported in The New York Jury Verdict Reporter, the leading reporter of verdicts and settlements of cases in New York State.
$140,000.00 settlement for a Houston woman with skin problems from using a defective hair removal cream
The claims of a facial hair removal product advertised in a popular magazine, attracted the attention of a Houston woman. The ad promised that the product would not only remove facial hair, but would also restore natural oils to the skin. The woman ordered the cream and began to use it. The results were far from what she has hoped for. The cream she received was from one of the many batches that were defectively manufactured. Use of the cream caused severe irritation and burning, and resulted in some discoloration to her face.
The defective hair removal cream was manufactured and distributed by two separate New York companies. A Houston, Texas law firm representing the woman recommended she retain Besen And Trop, L.L.P. Their recommendation resulted from being favorably impressed by past settlements and verdicts obtained by our firm. Besen And Trop was selected to handle this complicated product liability case against the two companies in Federal Court.
Stuart Besen prepared and filed a lengthy Federal Court Complaint, which cited numerous causes of action alleging Strict Liability and Breach of Implied Warranty among them. Extensive pre-trial discovery was conducted. Once completed, the case was prepared to go to trial.
Numerous law firms throughout the country were involved in similar lawsuits regarding the defective manufacturing and distribution of this product. It was learned that the $140,000.00 settlement obtained by Stuart Besen was the highest settlement attained in the United States against this manufacturer.
